Right of withdrawal
The Customer who is a consumer or user within the meaning of Article 3, co. 1, lett. a) of Legislative Decree no. 206 of 6 September 2005, as amended (Consumer Code) has the right to withdraw from the contract, without giving any reasons, within 14 days.
The withdrawal period shall expire after 14 days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods.
In order to exercise the right of withdrawal, the Customer must inform Pietro Parmeggiani S.r.l., Via S. Giovenale, 86 47921 Rimini, Tel +39 0541 56047, Fax +39 0547 650505, e-mail: info@sleepis.it, of his decision to withdraw from the contract by means of an explicit declaration (e.g. letter sent by post, fax or e-mail). For this purpose, he may use the standard withdrawal form available on this website, but it is not compulsory. The Customer may also electronically fill in and send the standard withdrawal form or any other explicit declaration on the website. If he chooses this option, Pietro Parmeggiani will send the Client, without delay, an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail).
In order to comply with the withdrawal period, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.
Effects of withdrawal
If the Customer withdraws from this contract, he will be reimbursed for all payments he has made to Pietro Parmeggiani, including the delivery costs (with the exception of additional costs resulting from the Customer’s choice of a type of delivery other than the least expensive type of standard delivery offered by Pietro Parmeggiani), without undue delay and in any event no later than 14 days from the day on which Pietro Parmeggiani was informed of the Customer’s decision to withdraw from the contract.
Such refunds will be made using the same means of payment used by the Client for the initial transaction, unless the Client has expressly agreed otherwise; in any event the Client shall not incur any costs as a result of such refund.
The refund may be suspended until receipt of the goods or until the Customer has demonstrated that he has returned the goods, whichever is earlier.
The Customer is requested to send back the goods or to deliver them to Pietro Parmeggiani S.r.l., Via S. Giovenale, 86 47921 Rimini without undue delay and in any case within 14 days from the day he communicated his withdrawal from the contract.
The term is respected if the Customer sends back the goods before the expiry of the 14-day period.
The direct cost of returning the goods will be borne by the Customer.
The cost is estimated to be equal to the expenses incurred by Pietro Parmeggiani for the delivery of the goods.
For contracts concluded outside business premises, if the products by their nature cannot be returned by mail, Pietro Parmeggiani will collect the goods at its own expense.
The customer is only liable for any decrease in the value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
